It is true that in accordance with Art. section of Directive EC of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data processing may be regulated in national law by a legal act however it should be noted that allowing non contractual entrustment of data without defining the exact conditions under which it would take place and specifying the criteria may raise interpretation doubts in the future.
